2nd Circ. Says Anthropologie Age Bias Suit Is Fit For A Jury
Law360 (April 8, 2019, 6:26 PM EDT) -- The Second Circuit on Monday revived a former Anthropologie employee's suit alleging she endured hostile treatment at work because she was nearly twice as old as most of her colleagues, saying that a trial court judge relied on faulty and outdated legal standards in tossing her claims.
In a published decision, a unanimous three-judge panel upended a 2017 decision by U.S. District Judge Thomas P. Griesa awarding summary judgment to Urban Outfitters Inc. and its Anthropologie retail brand over claims brought by former employee Blair Davis-Garett that they flouted the Age Discrimination in Employment Act by fostering a hostile work environment...
