Applebee's Servers Retain Class Cert. In FLSA Suit

Law360, New York (August 5, 2009, 4:08 PM EDT) -- A federal judge has shot down an attempt by Applebee's to decertify a class of servers and bartenders in a collective action accusing the restaurant chain of paying tipped wages instead of minimum wage to the employees in violation of the Fair Labor Standards Act, even as the workers were denied partial summary judgment.
