Ralph Lauren Must Face Customer Suit Over Excessive Texts
Law360 (May 2, 2019, 9:52 PM EDT) -- Ralph Lauren and its marketing affiliate can't ditch accusations they used an autodialer to send customers more promotional text messages than they had permission to, an Illinois federal judge said Thursday.
U.S. District Judge Sara Ellis disagreed with Ralph Lauren Corp. and marketing affiliate Vibes Media LLC that customer Patrick Hudson had “pleaded himself out of court” in his proposed class action by admitting he had previously consented to receive the texts. She pointed to Hudson's allegation that the companies sent him more than the maximum of six messages they said they would send per month.
