CVS Ditches False Ad Suit Over Joint Health Pills

Law360 (May 17, 2019, 7:20 PM EDT) -- CVS Health Corp. can escape a putative class action over claims it falsely advertised its line of CVS Health Glucosamine products, a California federal judge ruled Thursday, finding that the pharmacy giant's packaging complies with federal labeling law, preempting the state law claims asserted in the suit. 

In his suit, named plaintiff James Kroessler alleged CVS had violated a slew of California laws, including California's Unfair Competition Law, Business and Professional Code and Consumer Legal Remedies Act, by saying the products help with "joint pain, flexibility and mobility."
