$5M 'Made In USA' Action Against CVS Booted

Law360, New York (August 21, 2009, 2:52 PM EDT) -- A magistrate judge has tossed a proposed class action seeking more than $5 million from CVS Pharmacy for allegedly selling eyeglass repair kits labeled “Made in USA” that were actually manufactured using imported parts.

Magistrate Judge John Houston of the U.S. District Court for the Southern District of California on Wednesday dismissed the case without prejudice, citing a lack of subject matter jurisdiction that would allow the case to go forward in federal court.
