Southwire Sues Encore Over Cable Patent, Mark

Law360, New York (August 25, 2009, 6:28 PM EDT) -- Southwire Co. has slapped Encore Wire Corp. with a suit alleging that Encore infringed Southwire's patent and trademark in its marketing and selling of certain electrical cables.

Southwire filed its complaint Monday in the U.S. District Court for the Eastern District of Texas, alleging patent and trademark infringement, unfair competition and false and deceptive trade practices.

The patent-at-issue is U.S. Patent Number 6,486,395, “Interlocked metal-clad cable.” Southwire also owns U.S. Trademark Registration Number 3,292,777, for its MCAP design mark, according to the complaint.
