Windstream Can Alter Welfare Plan Benefits: Judge

Law360, New York (August 27, 2009, 3:23 PM EDT) -- A federal judge has ruled that Windstream Corp. did not run afoul of federal employment laws in changing welfare benefits in the retirement plan for several phone companies that preceded it, but that the telecommunications company can't unilaterally amend the plan's pension benefits.

Judge Warren K. Urbom of the U.S. District Court for the District of Nebraska on Wednesday granted summary judgment for Windstream, ruling that the company's amendments to the plan did not violate the Employee Retirement Income Security Act.
