Food Processing Workers Seek Cert. In FLSA Action

Law360, New York (September 9, 2009, 12:41 PM EDT) -- Food processing workers suing Alle Processing Corp. and several of its executives for allegedly not paying them sufficient overtime have moved to conditionally certify a collective action class in the case.

The motion, filed Tuesday in the U.S. District Court for the Eastern District of New York, seeks to certify a class of all current and former Alle employees who worked as food service employees and in other related trades at the company's food processing facility from Dec. 3, 2005, through the present.
