Kos Pharma Sues Barr Over Plans To Make Cholesterol Generics

Law360, New York (April 1, 2004, 12:00 AM EST) -- Kos Pharmaceutical has sued Barr Laboratories over its plans to make generic versions of two cholesterol drugs, Niaspan and Advicor.

The lawsuit claims that Barr’s intent to distribute a generic version of Kos' Niaspan drug infringes on Kos' patent for pharmacokinetic properties used in Niaspan and another Kos drug, Advicor.

The lawsuit, filed in U.S. District Court for the Southern District of New York, was triggered by Barr's notification that it has filed a Supplemental Paragraph IV Certification in connection with its previous Abbreviated New Drug...
