Staples Points To DOL Opinion Letter In New Trial Bid

Law360, New York (September 15, 2009, 3:17 PM EDT) -- Staples Inc. says it is entitled to a new trial in a wage-and-hour collective action in which the office products retailer was ordered to cough up more than $4.9 million following a New Jersey jury's February verdict in favor of hundreds of plaintiffs who said it failed to pay them the required premium rate for overtime hours in violation of the Fair Labor Standards Act.

Staples filed its motion for a new trial Sept. 14 in the U.S. District Court for the District of New Jersey....
