Judge OKs Inequitable Conduct Claims V. O2 Micro

Law360 (October 23, 2006, 12:00 AM EDT) -- In a setback for circuit maker O2 Micro International Ltd. in its patent infringement lawsuit against Monolithic Power Systems Inc. over inverter controller chips, a California district court has refused to strike down Monolithic’s counterclaims of inequitable conduct against O2 Micro.

U.S. Judge Claudia Wilken in the U.S. District Court for the Northern District of California did not agree with O2 Micro that Monolithic’s counterclaims against its acts of inequitable conduct were insufficient grounds for Monolithic’s California law tortuous interference and unfair competition claims.
