Wholesalers Drop Merck Antitrust Suit Over Singulair

Law360, New York (September 22, 2009, 3:27 PM EDT) -- Following a victory for Merck & Co. Inc. in a related patent suit, a group of drug wholesalers has dropped its proposed class action alleging that the drugmaker engaged in anti-competitive tactics to block generic versions of asthma and allergy drug Singulair.

Judge Garrett E. Brown Jr. of the U.S. District Court for the District of New Jersey signed off Monday on a dismissal notice filed Thursday by plaintiffs Louisiana Wholesale Drug Co. Inc., Burlington Drug Co. Inc. and Miami-Luken Inc.
