GE Delivery Drivers Found To Be Exempt From FLSA

Law360, New York (September 29, 2009, 5:00 PM EDT) -- A judge has granted summary judgment in a Fair Labor Standards Act class action filed against a delivery and installation service provider for General Electric Co. appliances, saying an exemption for interstate truckers applies to the case.

In an opinion Friday, Judge Lee H. Rosenthal of the U.S. District Court for the Southern District of Texas said the drivers for Dupar Inc., Dupar Properties Inc. and J. Kelly Parsons, the owner of Dupar, were not entitled to overtime compensation.
