Pa. Panel Says Ballard Spahr Can Arbitrate Malpractice Case

Law360 (April 6, 2020, 6:36 PM EDT) -- A divided Pennsylvania appeals court on Monday upended a decision that an arbitration agreement between an ex-client and the former Lindquist & Vennum LLP, now part of Ballard Spahr LLP, improperly limited the firm's potential liability as it faces claims that it gave faulty licensing advice.

In a 2-1 ruling, the state's Superior Court rejected a trial judge's contention that the arbitration agreement between Lindquist, which has since been absorbed by Ballard, and ex-client Mackin Medical Inc. violated ethics rules barring attorneys from entering into unfair contracts with clients.
