High Court Turns Nacchio Away

Law360, New York (October 5, 2009, 5:01 PM EDT) -- The U.S. Supreme Court has declined to hear the case of imprisoned former Qwest Communications International Inc. chief Joseph Nacchio, leaving the question of what expert testimony can be used in securities litigation on the table.

On Monday, the high court denied Nacchio's petition for writ of certiorari, letting stand the disgraced executive's conviction that was affirmed by the U.S. Court of Appeals for the Tenth Circuit last year.

The Supreme Court attached no comment to the decision, but an attorney for Nacchio expressed her disappointment...
