ACH Food Batters Suit Over Half-Full Baking Mixes, For Now

By Hannah Albarazi (April 21, 2020, 10:28 PM EDT) -- A California federal judge dismissed a proposed class action alleging ACH Food Companies Inc. purposefully packages baking mixes in half-full opaque boxes to mislead consumers, saying Monday that the suit failed to "allege facts to support the conclusion that the slack fill is nonfunctional."

Anthony Buso brought the suit against ACH Food in 2017, alleging consumers rely on the size of the nontransparent packaging of Fleischmann's Simply Homemade Baking Mix products to gauge the amount of mix they're buying, but that ACH Food only fills the boxes about halfway in violation of California's Consumer Legal Remedies Act, Unfair Competition Law and...
