PBGC Loses Bid For Access To Freedom Documents

Law360, New York (October 12, 2009, 4:22 PM EDT) -- A bankruptcy judge has shot down a bid by the Pension Benefit Guaranty Corp. to force newspaper company Freedom Communications Holdings Inc. to give it access to all the documents it shows to the other members of the official committee of unsecured creditors.

Judge Brendan Linehan Shannon, of the U.S. Bankruptcy Court for the District of Delaware, ruled Friday that Freedom had “demonstrated substantial, valid concerns” that if the documents were shared with the PBGC, they might get disclosed to third parties.
