High Court To Weigh In On Benefits Suit Preemption

Law360, New York (October 13, 2009, 3:53 PM EDT) -- The U.S. Supreme Court has agreed to weigh in on a case concerning whether a state court lawsuit over a federal employee's health care benefits is preempted by federal law.

The high court said Tuesday it would weigh in on the lawsuit that was initially filed by Juli Pollitt, a government employee, against Health Care Service Corp., a contractor tasked with administering the health care benefits she received as part of her employment.
