TEOHC Director Hit With Injunction In ERISA Suit

Law360, New York (October 15, 2009, 5:37 PM EDT) -- A federal judge has enjoined a former director of plastics maker Noll Manufacturing Co.'s employee-owned holding company from arbitrating an agreement that would require the company to indemnify him in an employment and securities lawsuit alleging he breached his fiduciary duty to Noll workers.

Judge Ralph R. Beistline of the U.S. District Court for the Eastern District of California entered a preliminary injunction on Oct. 9 barring Bruce Couturier, a former director of The Employee Ownership Holding Co. and brother of its president, from going forward...
