Mass. High Court OKs Smokers' Medical Test Suit

Law360, New York (October 19, 2009, 7:16 PM EDT) -- The high court in Massachusetts has paved the way for a putative class of Marlboro smokers to sue Philip Morris USA Inc. to pay for medical monitoring to detect lung cancer in its early stages.

On Monday, the Massachusetts Supreme Judicial Court answered two questions certified by the U.S. District Court for the District of Massachusetts: whether the suit for medical monitoring stated a cognizable claim under Massachusetts state law, and if it did state a claim, whether it was barred by a statute of limitations....
