Fed. Circ. Told RPX Wins Over Mobile Website IP Weren't Fair

Law360 (July 15, 2020, 10:31 PM EDT) -- Publishing Technologies LLC has urged the Federal Circuit to revive its mobile website patent, arguing it wasn't given a fair chance to fight its case against RPX Corp. at the Patent Trial and Appeal Board.

Publishing Technologies' opening brief from Tuesday argued that the PTAB violated the Administrative Procedure Act by refusing to construe claims until its final written decisions. Additionally, the appeal claimed that RPX left information about relevant prior litigation and related parties out of its petitions.
