11th Circ. Revives Church's Hurricane Matthew Insurance Suit

Law360 (July 15, 2020, 5:46 PM EDT) -- The Eleventh Circuit on Wednesday revived a Georgia church's suit against Southern Mutual Church Insurance Co. seeking coverage for roof damage caused by Hurricane Matthew, holding that the lower court wrongly ruled that the church was damaged by water, not by wind.

In an unpublished opinion, a three-judge panel said that the Georgia federal court wrongly held that the church failed to sufficiently prove that damage to it was caused by Hurricane Matthew in 2016. Greater Hall Temple Church of God's policy with Southern Mutual does not preclude its claim and clearly covers the alleged damage, the panel wrote.
