Fla. Appeals Court Upholds $7.25M Verdict Against RJR

Law360 (July 15, 2020, 3:47 PM EDT) -- A Florida appeals court on Wednesday upheld a $7.25 million verdict for a former smoker against R.J. Reynolds Tobacco Co. in an Engle progeny suit, rejecting the cigarette maker's argument that the ex-smoker had to describe which specific advertisements misled him on the dangers of cigarettes.

The decision affirmed the victory for Paul E. Rouse, who had alleged that he began smoking at the age of 9 in the 1960s, developed symptoms of coronary artery disease in 1995 after a lifetime of smoking, and quit smoking after a triple bypass surgery in 1999, according to court documents.
