Marathon, Insurers Battle Over Forum In Gasoline Spat

Law360, New York (October 21, 2009, 2:50 PM EDT) -- Marathon Petroleum Co. LLC is seeking to send a lawsuit it brought against its insurers back to state court, saying federal courts do not have jurisdiction in its case alleging the insurers failed to pay for litigation over contaminated gasoline.

Marathon filed its motion to remand on Tuesday in the U.S. District Court for the Northern District of Ohio, saying the federal court lacks diversity jurisdiction in the case because Marathon and one of the defendants are citizens of the same state.
