Putative ERISA Class Action Against BP Still In Play

Law360, New York (October 22, 2009, 2:00 PM EDT) -- Attorneys for a putative class of retirees of BP North America Inc. say they will continue to press for class certification now that a federal judge has denied the energy giant's bid to toss the case accusing BP of using illegal interest rates in pension plan conversions.

U.S. District Judge David L. Bunning of the Eastern District of Kentucky denied BP's dismissal motion Oct. 15, rejecting its argument that the plaintiffs could not sue because they had not exhausted their administrative remedies.
