New Anti-Bias Rule For Pa. Attys Hit With Legal Challenge
Law360 (August 6, 2020, 8:01 PM EDT) -- A Philadelphia attorney launched a federal lawsuit Thursday alleging that a recently adopted ethics rule barring expressions of bias or prejudice by members of the Pennsylvania bar runs afoul of First Amendment free speech protections.
Zachary Greenberg, an attorney with the Philadelphia-based Foundation for Individual Rights in Education, said that a new rule would force him to stop advocating for controversial positions, including the constitutionality of hate speech and the rights of individuals accused of sexual assault, out of fear that he would be subject to disciplinary action.
