NY High Court Says Tyco Didn't Breach Cable Contract

Law360, New York (October 22, 2009, 6:18 PM EDT) -- New York's highest court on Thursday affirmed an appeals court's opinion that Tyco Group Sarl did not breach a contract with fellow telecommunications company IDT Corp. over access to a massive underwater cable system, effectively ending more than five years of litigation.

The New York State Court of Appeals rendered an opinion declaring that the contentious 2000 settlement agreement between the companies cannot be considered breached because its terms were contingent on the execution of future contracts that were never negotiated.
