States Want Judge Off Allegheny Energy Clean Air Case

Law360, New York (October 26, 2009, 5:20 PM EDT) -- The Pennsylvania Department of Environmental Protection and four other states that filed a Clean Air Act suit against Allegheny Energy Inc. over allegedly unapproved and emission-increasing changes to coal-fired power plants have asked a federal judge to disqualify himself from the case.

The Pennsylvania DEP and the states of New York, Connecticut, Maryland and New Jersey filed the disqualification motion in the U.S. District Court for the Western District of Pennsylvania on Friday, asking Judge Terrence F. McVerry to recuse himself from the matter.
