Sanctions Sought In Wine Of The Month Trademark Spat

Law360, New York (October 27, 2009, 7:47 PM EDT) -- Retailer ICG America Inc. asked for sanctions Tuesday in its trademark suit against Wine of the Month Club Inc. alleging the phrase "wine of the month club" is generic, seeking legal costs for a racketeering counterclaim.

ICG said it wanted the club to pay the legal costs of the club's supposedly “specious” Racketeer Influenced and Corrupt Organizations Act counterclaim, as well as the “withdrawal from the docket of the slanderous pleading,” according to the motion, filed in the U.S. District Court for the District of Connecticut....
