Philly Papers' Ch. 11 Sparks 1st Amendment Battle

Law360, New York (October 30, 2009, 12:43 PM EDT) -- A charter schools company that accuses the Philadelphia Inquirer of defamation is pressing its fight against the paper's bankrupt parent in a bankruptcy appeal, arguing an injunction blocking the paper from getting details about the company via Pennsylvania’s Right to Know Law is enforceable.

Charter School Management Inc.'s appellate brief, filed Thursday in the U.S. District Court for the Eastern District of Pennsylvania, claims that injunctive relief against Philadelphia Newspapers LLC, granted in August, not only is legally sound but the newspaper chain agreed to it....
