Express Scripts Prevails In Another AWP Fight

Law360, New York (October 30, 2009, 1:11 PM EDT) -- A federal judge has tossed out a class action alleging Express Scripts Inc. failed to reimburse certain Alabama pharmacies for brand-name prescription drugs by neglecting to consistently update the drugs' average wholesale price as laid out in their contracts.

On Thursday, Judge W. Keith Watkins of the U.S. District Court for the Middle District of Alabama granted Express Scripts' motion for summary judgment while shooting down a bid from plaintiffs Pearson's Pharmacy Inc. and Altadena Pharmacy for partial summary judgment.
