Google Gets PTAB To Review 2 Data Processing Patents

Law360 (October 6, 2020, 6:36 PM EDT) -- The Patent Trial and Appeal Board will review two data processing patents that Personalized Media Communications has accused Google of infringing, rejecting the patent-holding company's argument that the petitions should fail because the U.S. Patent and Trademark Office considered the same prior art during prosecution.

Though the PTAB agreed with Personalized Media Communications LLC that several of the prior art references were before the USPTO during examination, it said in two Oct. 2 decisions instituting inter partes review of the patents that the examiner did not consider the specific arguments Google made in its petitions about those references.
