NY Court Dismantles Suit Over Patient's Paralysis And Death

By Sarah Jarvis (October 14, 2020, 8:23 PM EDT) -- A New York appeals court on Wednesday reversed the denial of quick wins to three doctors accused of causing a patient's paralysis and death, saying the patient's wife's experts engaged in speculation.

The panel disagreed with the Supreme Court of Westchester County's denial of the summary judgment motions brought by physicians Michael S. Canter, Donald McKnight and Andrew Moulton, saying they submitted evidence that they did not depart from accepted medical practices "and, in any event, that any alleged departures were not a proximate cause of the decedent's paralysis and ultimate death."
