Compliance Lessons From DOJ's Merit Medical Settlement

Law360 (November 3, 2020, 5:36 PM EST) -- On Oct.14, the U.S. Department of Justice announced a settlement agreement with Utah-based medical device manufacturer, Merit Medical Systems Inc., to resolve alleged violations of the federal Anti-Kickback Statute and False Claims Act and numerous state false claims act statutes.

These allegations stem from a complaint filed by Merit's former chief compliance officer, who filed a qui tam action in April 2016. Merit denied the allegations. This is just the latest pulling out the whistle by a former member of the company compliance fold within a life sciences organization, and it can be expected to happen again.
