Claims Spun Out Of Sears Defective Washer Suit

Law360, New York (November 5, 2009, 1:23 PM EST) -- A federal judge has tossed the majority of claims in a consolidated class action against Sears Roebuck & Co. in which customers accused the retail giant of selling defective washing machines.

Judge Joan Lefkow of the U.S. District Court for the Northern District of Illinois threw out 16 consumer fraud claims and one unjust enrichment claim Wednesday, agreeing with Sears that some of those claims had already been dismissed with prejudice.
