Discover Looks To Ax Patent Suit Over Mobile Banking Tech

Law360 (November 12, 2020, 8:17 PM EST) -- Two Discover subsidiaries urged an Illinois federal judge to toss a patent infringement suit from a Georgia-based company against their mobile app and other digital banking services, arguing the five patents aren't practiced.

The August suit from Kioba Processing LLC alleges that DFS Services LLC and DFS Corporate Services LLC, subsidiaries of Discover Financial Services, infringed on five patents. But the companies claimed in their Tuesday motion to dismiss that the patents are "five unrelated, never-before-asserted, expired or nearly-expired" patents that "nobody practices."
