Children's Hospital Wins Initial Victory In Antitrust Spat

Law360, New York (November 9, 2009, 4:08 PM EST) -- A California children's hospital has won the dismissal of one antitrust claim in a lawsuit over neonatal care, but an attorney for the medical group that sued the hospital says he plans to amend the complaint.

Judge Lawrence J. O'Neill of the U.S. District Court for the Eastern District of California tossed the antitrust claim levied by Perinatal Medical Group Inc. against Children's Hospital Central California because the hospital and its alleged co-conspirator, Specialty Medical Group, are the same entity.
