Home Depot Asst. Managers Seek Cert. In OT Suit

Law360, New York (November 10, 2009, 3:12 PM EST) -- Two former assistant store managers have asked a federal judge for class certification in a suit accusing Home Depot USA Inc. of deliberately misclassifying them as exempt from California labor law in order to avoid paying a premium rate for overtime hours.

Named plaintiffs Areceli Mendoza and Kyle Diamond on Monday filed a bid for class certification in the U.S. District Court for the Central District of California.
