Insurer Wants Out Of Class Action Over Medical Bills

Law360, New York (November 13, 2009, 4:10 PM EST) -- Indian Harbor Insurance Co. has sued for a declaratory judgment in federal court, arguing that it has no duty to defend BestComp Inc. in a class action over medical providers' workers' compensation bills.

In the U.S. District Court for the Eastern District of Louisiana on Thursday, Indian Harbor contended that BestComp was not an insured party under the policy in question and that claims advanced in the medical providers' suit were not reimbursable under the policy provisions.
