Law Firms Sue DHS Over 'Trial By Ambush' Records Policy

Law360 (January 19, 2021, 7:48 PM EST) -- Law firms frustrated with fighting federal immigration officials for copies of their clients' records are suing the U.S. Department of Homeland Security and other agencies for withholding case documents and forcing immigrants to face "trial by ambush."

Greater Boston Legal Services, three small law firms and their attorneys — represented by the American Civil Liberties Union of Massachusetts and Ropes & Gray LLP — filed the suit Friday, asking a Massachusetts federal judge to strike down the agencies' practice of denying access to records that may aid an immigrant's defense.
