Caterpillar Retirees Denied Jury Trial In ERISA Action

Law360, New York (November 18, 2009, 12:21 PM EST) -- A federal judge has refused to grant a jury trial in a consolidated class action accusing construction giant Caterpillar Inc. of denying its former employees retirement benefits.

Judge Aleta A. Trauger of the U.S. District Court for the Middle District of Tennessee on Monday denied the plaintiffs' request for a jury trial, saying that Sixth Circuit precedent bars a jury trial because the employees are requesting equitable, not legal, relief.
