Fed. Circ. Says Ads Invalidated Supplement Patent

Law360, New York (November 19, 2009, 6:31 PM EST) -- A federal appeals court on Thursday struck down infringement claims for a bodybuilding supplement patent held by Iovate Health Sciences Inc. and the University of Florida Research Foundation, ruling that certain fitness magazine ads describing the product had rendered the patent obvious.
