EEOC Can Seek Info On UPS Beard Ban: 2nd Circ.

Law360, New York (November 19, 2009, 7:22 PM EST) -- A federal appeals court has cleared the way for the U.S. Equal Employment Opportunity Commission to seek more information about how UPS Inc. handles religious exemptions to its nationwide ban on beards for certain employees.

The U.S. Court of Appeals for the Second Circuit on Thursday reversed a lower court’s decision, which refused to enforce the EEOC’s subpoena after concluding that how the package delivery company addresses the exemptions on a nationwide basis was irrelevant to the individual religious discrimination cases being investigated by the agency....
