Mattress Firm Tells Texas High Court Emails Are Free Speech

Law360 (February 11, 2021, 9:59 PM EST) -- Bedding chain Mattress Firm is asking the Texas Supreme Court to order the dismissal of a former Colliers International real estate broker's claims he was harmed by its allegations he was involved in a kickback and bribery scheme, saying emails the company sent about the purported plot are protected free speech.

In a petition for review filed Thursday, Houston-based Mattress Firm said a state appeals court misinterpreted the Texas Citizens Participation Act, a law aimed at protecting comments made about people or matters of public concern, when it refused to drop the broker's claims.
