Dornoch, PBM Settle $6M Tainted Formula Dispute

Law360, New York (November 24, 2009, 12:27 PM EST) -- Infant formula distributor PBM Nutritionals LLC and insurer Dornoch Ltd. have reached a confidential settlement in a battle over who should pay for losses arising from $6 million in tainted baby formula.

A federal judge in the U.S. District Court for the Southern District of New York rendered an order Monday approving the settlement, which dismisses allegations from both sides, with prejudice, in two separate federal court proceedings related to the matter, according to an attorney for PBM.
