Trade Show Co., Insurer Battle Over Notification

Law360, New York (November 24, 2009, 2:29 PM EST) -- Rockland Exposition Inc. and Great American Assurance Co. are sparring over whether the automobile trade show promoter timely notified the insurer of a trademark infringement suit against it, which is at the crux of Rockland's duty-to-defend case against the insurer.

In a memo filed Monday with the U.S. District Court for the Southern District of New York, Rockland argues that its oral notification of insurance broker Marshall & Sterling in August 2008, two months after it was served with the underlying complaint, should constitute timely notice....
