Cherokee Try Again To Join Chicken Waste Suit

Law360, New York (November 24, 2009, 4:17 PM EST) -- The Cherokee Nation has appealed a district court's denial of its request to intervene in an action brought by the state of Oklahoma accusing Tyson Foods Inc. and seven other poultry processors of polluting the Illinois River with chicken waste.

In an appellant brief lodged Monday in the U.S. Court of Appeals for the Tenth Circuit, the American Indian nation argued that the U.S. District Court for the Northern District of Oklahoma incorrectly ruled on Sept. 15 that the Cherokee Nation's bid to intervene was untimely....
