Google Wins Fed. Circ. Fight Over Real Party In Interest Ruling

Law360 (March 16, 2021, 10:47 PM EDT) -- The Federal Circuit affirmed Tuesday that Patent Trial and Appeal Board rulings on real party in interest disclosures are final and can't be appealed, cementing Google's successful challenge of claims in two CyWee patents that cover motion sensor technology.

Two months after oral arguments, the three-judge panel issued a nonprecedential decision shooting down Taiwan-based startup CyWee Group Ltd.'s appeal of PTAB rulings last year that found that claims in two of its patents were rendered obvious by prior art that Google LLC presented in its petitions for inter partes review.
