Calif. Court Rejects Board's Disability Calculations

Law360, New York (December 1, 2009, 7:25 PM EST) -- Overturning a decision by the state’s Workers' Compensation Appeals Board, a California appeals court has found that cost-of-living adjustments in disability benefits for injured workers should accrue starting from Jan. 1, 2004 — the date specified by statute — regardless of when the injury occurred or when the injured worker begins receiving payments.
