NY Docs Can't Escape Suit Over Anal Cancer Death

Law360 (March 26, 2021, 3:34 PM EDT) -- Two doctors must face a wrongful death suit alleging they failed to diagnose and treat a man's fatal anal cancer, after a New York appeals court found that competing expert opinions create a factual dispute that a jury will have to address.

The appeals panel affirmed an order from February 2020 that denied motions by physician Susan Choi and her employer Guthrie Medical Group PC dermatologist Joseph Newmark, who sought summary judgment on Debra Colon's claim that they failed to save her husband, Eltor Colon.
